Welcome to NoteStacker ("we," "our," or "us"). By accessing or using our website at notestacker.cc (the "Site") or our application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

1. Use of Services

You must be at least 18 years old to use our services. You agree to use the App and Site only for lawful purposes and in accordance with these Terms. NoteStacker is an independent tool not affiliated with Substack, and you are responsible for complying with Substack's terms when using our App.

2. Account and Licensing

To use certain features, you may need to create an account or activate a license key provided after purchase. You agree to provide accurate information and keep it updated. Licenses are non-transferable and support up to 3 activations per user. We reserve the right to suspend or terminate your access if you violate these Terms.

3. Payments and Subscriptions

Our App is available for purchase at $14.99 per month, with a 7-day free trial. Payments are processed through third-party providers like Gumroad. All sales are final except for refunds within the first 7 days if unsatisfied. We may change pricing with notice.

4. Intellectual Property

All content, features, and functionality of the App and Site are owned by NoteStacker and protected by copyright, trademark, and other laws. You are granted a limited, revocable license to use the App for personal, non-commercial purposes.

5. AI Features and Content Generation

The App uses AI to generate text, images, and videos. You are responsible for all content you create or schedule using our tools. We do not claim ownership of your generated content, but you grant us a license to use it for improving our services.

6. Limitations of Liability

To the fullest extent permitted by law, NoteStacker shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App or Site. Our total liability shall not exceed the amount you paid us in the last 12 months.

7. Indemnification

You agree to indemnify and hold harmless NoteStacker from any claims arising from your use of the services, violation of these Terms, or infringement of third-party rights.

8. Changes to Terms

We may update these Terms at any time. Continued use after changes constitutes acceptance.

9. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles.
